Joel Berman Glass Studios - Systems Ambient Spray Coating Warranty

Joel Berman Glass Studios International Ltd. warrants that subject to the terms and conditions listed below, any panel of Treated glass:

(a) will not vary from its original delivery colour by more than 5 units in the DeltaE scale; and

(b) the Treatment will adhere to the glass

for a period of 2 years from the date of delivery for glass installed in an interior application, or for a period of 1 year from the date of delivery for glass installed in an exterior application. All warranties are subject to pre-approval by Joel Berman Glass Studios International Ltd. based on material location, and application.

Joel Berman Glass Studios International Ltd. will, at its option, and subject to the terms stated below, repair or replace a panel of Treated glass which;

(a) varies from its original delivery colour by more than 5 units in the DeltaE scale; or

(d) the treatment no longer adheres to the glass

provided that the customer has notified Joel Berman Glass Studios International Ltd. in writing, within 30 days of discovering the failure, and within the warranty period described above.

The Warranty for any replacement or repaired Treated panel will extend for the remainder of the original warranty period only. This warranty will not apply:

(a) if the panel has been subjected to misuse, abuse, accident, or want of care;

(b) if the panel has not been maintained in accordance with the maintenance information as provided by Joel Berman Glass Studios International Ltd.;

(c) if repairs or alterations have been made or attempted by a person other than an authorized Joel Berman Glass Studios International Ltd. representative;

(d) to the extent that any damage or colour variation is caused by any breakage, chipping, cracking, or damage to a panel after its delivery, however caused;

(e) if the panel has not been pre-approved for use by Joel Berman Glass Studios International Ltd. based on material location, and application, prior to installation.

Joel Berman Glass Studios International Ltd. does not warrant the glass on which the treatment is applied, including without limitation, its suitability for use. To the extent that it is able to do so, Joel Berman Glass Studios International Ltd. will, at the request and expense of the customer, pass on to the customer the benefit of any applicable warranty that it receives from the glass supplier.

Except as herein provided Joel Berman Glass Studios International Ltd. makes no warranty or guarantee, express or implied, including warranties of fitness for a particular purpose or merchantability, respecting its products.

In no event will Joel Berman Glass Studios International Ltd. have any liability for any incidental, consequential or other damages (such as injury to persons or damage to any structure or its contents), including damage resulting from installation of its product. Some states do not allow the exclusion or limitation of consequential damages, so the above limitations or exclusions may not apply to you.

Joel Berman Glass Studios International Ltd. does not warrant the installation of any materials, and is not responsible for any damage directly or incidentally caused to its products or any other persons or products, due to installation. Joel Berman Glass Studios International Ltd. will not be liable pursuant to this warranty for any cost or consequential damage or economic loss, whether direct or indirect, to any person or property arising from Treated glass or the glass treatment supplied to the customer, and no responsibility is implied or accepted over and above the repair or replacement outlined in this document. All other customers, including without limitation any warranty implied under any Sale of Goods legislation, or the Trade Practices Act, or by any other law, are excluded to the extent permitted by law.

If during the Warranty period, any product proves to be defective, Joel Berman Glass Studios International Ltd. in its sole discretion shall offer to replace the defective portion of the product FOB the point of origin to which the original product was supplied. Joel Berman Glass Studios International Ltd. shall not be responsible for the cost of removal, replacement, or other related costs or taxes regarding defective materials. The warranty applies only to the purchaser of the glass and the owner of the structure to which it was installed provided adequate proof of purchase is furnished.

The original customer may not assign the benefit of this warranty to any other party without the written consent of Joel Berman Glass Studios International Ltd.

Treatment means the coating treatment applied by Joel Berman Glass Studios International Ltd. to a panel of glass.

Warranty means the warranty as described in this document.
